ובשמו תשבע. מה ת"ל והא כבר נאמר בזה (פ' ואתחנן) ואלא אתיא לכדרב, דאמר, מניין שנשבעין לקיים את המצוה, שנאמר (תחלים קי"ט) נשבעתי ואקימה לשמור משפטי צדקך לכאורה לפי זה מיותר הראיה שמביא מפסוק דתהלים אחרי דמוקים פסוק זה לענין זה, וי"ל משום דמפסוק זה לחוד אפשר לומר דמצוה להשבע רק כדי לאפרושי מאיסורא, קמ"ל מפסק נשבעתי ואקיימה דמותר לשבע גם לקיום המצות המעשיות, וכמשמעות הלשון נשבעתי ואקיימה לשמור, והיינו לזרוזי נפשיה, ועיין בנדרים ז' א' מענין זה. ויתר הענינים השייכים לדרשה זו ולפסוק זה ולהלשון את ה' אלהיך תירא בארנו הכל לעיל פ' ואתחנן (ו' י"ג) יעו"ש וצרף לכאן.
English: “And by His name you shall swear” — what does this teach, given that this already appears in Vaetchanan? It comes for Rav’s teaching: Whence that one may swear to fulfill a mitzvah? As it is said (Tehillim) “I have sworn and I will fulfill, to keep Your righteous judgments.” This verse alone might allow an oath only to distance from prohibition; the Tehillim verse shows one may also swear in order to spur oneself to positive mitzvot.
